1. Introduction
Welcome to ClearMind Quit. By accessing or using our website and mobile application (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Service Description
ClearMind Quit provides information, behaviour-change support and AI-assisted conversational support for people stopping smoking or vaping. This includes a personalised quit plan, a craving-response tool, daily tracking, a curated 28-day programme with an optional 90-day growth phase, general education about nicotine replacement and stop-smoking medicines, and links to official support services.
3. User Accounts
To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials.
4. Premium Features and Payments
A free tier is available and does not require payment or card details. Some features — including the full personalised 28-day programme, the 90-day growth phase, personal trigger insights, full chat coach access and voice support — are part of the paid "28-Day Plus" plan. 28-Day Plus is a one-time payment, not a subscription: nothing recurring is set up and nothing renews. Prices are shown in euro and VAT or local sales tax may be added at checkout depending on your country. Payments are processed by Stripe; card details never reach our servers. AI features on both plans are subject to daily fair-use limits that protect service quality — they are not unmetered. For refunds or billing help, contact welcome@clearmindquit.com; statutory rights, including any right of withdrawal for digital content, are unaffected. 5. Medical Disclaimer
ClearMind Quit is not a medical device and does not provide medical advice, diagnosis or treatment. Content is for information and behavioural support only. The AI features are a behaviour-change support coach — not a doctor, pharmacist, nurse, counsellor or certified stop-smoking adviser — and they do not diagnose symptoms or set medication doses. Decisions about nicotine replacement or stop-smoking medication should be discussed with a pharmacist, GP, stop-smoking adviser or other appropriately qualified professional. Digital self-help does not work equally well for everyone, and many people do best combining an app with professional behavioural support and approved cessation medication. Progress recorded in the Service is mainly self-reported, and a streak is a motivational metric rather than proof of long-term abstinence. AI responses may be imperfect. Local provider information, including anything returned by AI search, should be independently verified. Always seek the advice of a qualified health professional about a medical condition, and never disregard or delay it because of something you have read here. ClearMind Quit is not affiliated with, endorsed by or approved by the HSE, the NHS, NICE or any other health body.
6. Acceptable Use
You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, or impairs the service. You agree not to upload, post, or transmit any content that is offensive, defamatory, or infringes on the rights of others.
7. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of ClearMind Quit and its licensors. The Service is protected by copyright, trademark, and other laws.
8. Limitation of Liability
In no event shall ClearMind Quit, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
